By accessing and using FXer ("the Platform"), you agree to these terms. If you do not agree with any part, please do not use our services.

1. Terms of use

Definitions

• User: any individual or entity who accesses or uses the Platform.
• Content: all information, data, text, or materials uploaded, shared, or generated on the Platform.
• Services: all tools, features, subscriptions, and functionality provided by FXer.

Subscriptions and payments

• FXer offers four monthly subscription tiers, each providing different levels of features and usage limits.
• Subscription fees are billed in advance on a recurring monthly basis unless canceled by the user.
• Payments are processed securely via Stripe.
• Upgrading or ordering a new subscription plan cancels your current plan immediately.

Refund policy: All payments are final and non-refundable. Users are responsible for canceling subscriptions if they no longer wish to continue.

User responsibilities

You are responsible for all content you upload and for maintaining account security. You must keep backup copies of your data. FXer is not responsible for data loss.

Prohibited activities

• Unauthorized access or attempted hacking.
• Automated scraping or bot usage.
• Reselling subscriptions or sharing accounts.
• Uploading unlawful or misleading content.

Intellectual property

All software, branding, and designs are the exclusive property of FXer. Users may not copy, reproduce, or distribute materials without consent.

Limitation of liability

FXer provides tools for trade tracking and analytics, but does not guarantee uninterrupted service or provide investment advice. FXer is not liable for damages arising from use of the Platform.

Indemnification

You agree to indemnify and hold harmless FXer against claims resulting from your use, content, or violations of these Terms.

Force majeure

FXer shall not be liable for events beyond its reasonable control, such as natural disasters, cyberattacks, or government actions.

2. Privacy policy

Data we collect

• Account data: name, email, billing details, subscription plan.
• Uploaded content: trade records, account details, journal entries.
• Usage data: IP address, browser type, device information.
• Analytics: FXer uses Google Analytics to collect anonymized usage statistics.
• Cookies: Used to enhance experience and enable analytics.

How we use data

• To provide and improve our Services.
• To process payments (via Stripe).
• To analyze usage trends (via Google Analytics).
• To communicate with users regarding updates or support.
• To comply with legal obligations.

International users

If you access FXer from outside the EU/EEA, your data may be transferred internationally. We use safeguards such as EU-approved Standard Contractual Clauses (SCCs) with processors like Stripe and Google to ensure GDPR compliance.

GDPR rights

Users in the EU have the right to access, correct, delete, or restrict processing of their data. You may request a copy of your data or withdraw consent for processing at any time.

3. Cookie policy

FXer uses cookies and similar technologies to:

• Enable essential platform functionality.
• Analyze usage with Google Analytics.
• Manage billing and sessions securely.

By using FXer, you consent to the placement of cookies. You may manage or disable cookies in your browser settings, but some features may not function properly without them.

4. Data processing agreement (DPA)

As required under GDPR, FXer has Data Processing Agreements in place with third-party service providers, including Stripe (payment processing) and Google (analytics). These DPAs ensure that:

• Processors only act on FXer's documented instructions.
• Appropriate technical and organizational measures protect your data.
• Cross-border transfers comply with EU safeguards.

By using FXer, you acknowledge that your data may be processed by these third parties in accordance with their respective DPAs and privacy policies.

5. Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of Estonia. Any disputes shall be resolved exclusively in the courts of Estonia.
